LEASES

There are two types of leases provided for by the legal system:
In the first place, and according to article 1,543 of the Civil Code “in the lease of things, one of the parties agrees to give the other the enjoyment or use of a thing for a determined time and a certain price.”
For its part, article 1,544 of the Civil Code provides that “in the lease of works or services, one of the parties undertakes to execute a work or to provide the other with a service for a certain price.”
For residential or industrial use
Within the leasing of things, the most common is the leasing of real estate, whether for residential use or industrial use (premises, warehouses, etc.).
The Urban Leasing Law regulates, in addition to the Civil Procedure Law and the Civil Code, all aspects related to the legal business of leasing, from the people who must intervene in a leasing contract, to the different eviction procedures, depending on of the nature of the use of the leased property.

CONTRACTUAL AND NON-CONTRACTUAL LIABILITY

Thus, article 1101 of the Civil Code provides that “those who in compliance with their obligations commit fraud, negligence or late payment, and those who in any way contravene the tenor of those are subject to compensation for damages caused”.
For its part, Article 1902 of the Civil Code states that “anyone who by action or omission causes damage to another, intervening fault or negligence, is obliged to repair the damage caused.”

Through the usucapion or acquisitive prescription, the property of a real estate property or of another nature is acquired for the continued use during the time and with the conditions established by the Law.
OF THE LOAN

According to article 1,470 of the Civil Code “by the loan contract, one of the parties delivers to the other, or something non-expendable so that they can use it for a certain time and return it, in which case it is called bailment, or money or another fungible thing, on condition of returning the same amount of the same kind and quality, in which case it simply retains the name of the loan”.
